What must an Austrian imprint contain?
Every business website falls under § 5 of the E-Commerce Act: name or Firma, the geographic address where you are established and a quick way to reach you, including an email address. Add your VAT number, company register number and register court if you have them.
With a trade licence you name your chamber, the trade authority and the Trade Act with a link. Without a company register entry, § 63 of the Trade Act asks for your name and the location of the trade licence.
Businesses in the company register state their Firma, legal form, seat, register number and register court under § 14 of the Commercial Code. For a GmbH & Co KG the same details are needed for the GmbH as well.
On top comes the disclosure under the Media Act. For a small website that only presents your business and its services, name or Firma, business activity and place of residence or seat are enough.
Small or large website?
Under the Media Act a website is large if it goes beyond presenting your business and can influence public opinion, for example with a blog or articles. You then also name the people authorised to represent you, the ownership and the editorial line (Blattlinie).
According to the WKO, a web shop with reviews or a guest book does not make a website large.
Which address goes in the imprint?
The geographic address where you are established, with street and number. The WKO describes it as an address fit for service of documents by authorities and courts. A PO box is not enough.
Whether a rented business address is enough depends on where you actually carry on your business. If in doubt, ask the WKO or your tax adviser.
Where the imprint must be
The E-Commerce Act requires the details to be permanently, easily and directly accessible. The usual way is an "Impressum" link in the footer of every page. The WKO advises publishing the imprint on your own website rather than only linking elsewhere.
Imprint on social media
According to the WKO the duties apply to all electronic content, so also to business profiles on platforms such as Facebook or XING, and to apps. Many businesses put a clearly visible link to their website's imprint in the profile.
Frequently asked
Is the imprint generator free?
Yes, with no sign-up. Everything runs in your browser. We store and send nothing you enter.
Do I need an imprint as a sole trader?
Yes, as soon as your website is a business website. The E-Commerce Act applies to every website run as a business, even if nothing is sold on it. Give your VAT number if you have one.
Must a GmbH name its managing directors?
Under Austrian law only on a large website. The WKO still advises adding them if you also have customers in Germany, where they are always required.
May I give a business address in my imprint?
The imprint states the geographic address where you are established (§ 5 E-Commerce Act). Whether a business address is enough depends on where you actually carry on your business. If in doubt, ask the WKO or your tax adviser.
Do I need an imprint on Facebook or Instagram?
For a business profile, yes. According to the WKO the duties also apply on social media. A clearly visible link to your website's imprint is the usual way.
What happens without a correct imprint?
Missing details under the E-Commerce Act can mean an administrative fine of up to €3,000. For missing or wrong disclosure under the Media Act it is up to €20,000. The register court can enforce the § 14 Commercial Code details with coercive fines.
